Information regarding personal data processing

Both data privacy and information confidentiality are important aspects for the BarcelonaBeta Foundation. This data protection policy establishes how personal data obtained are treated and it may vary with time due to the possible legislative, jurisprudential changes, or changes of the criteria followed by the Spanish Data Protection Agency and/or the competent authority at any time. For this purpose, the BarcelonaBeta Foundation reserves the right to modify this policy to adapt it to legislative or jurisprudential developments that are in force at the precise moment of website access.

2.- Processing identification. For what purpose will we process your data, with what legitimation will we do it and how long will we store these data for?

The BarcelonaBeta Foundation processes your data according to the collaboration relationships that you have with us. The data that we collect are those strictly necessary to manage established relationships; these data are appropriate, relevant and not excessive, limited to what is required for the purposes of their processing. In order to keep current data accurate and updated, we ask you to report any change or modification that may occur.

We describe below, the activities performed by the BarcelonaBeta Foundation so that you can identify on which databases your personal data are processed and for what purposes:

 

2.1. FORMS WEB

The personal data that you provide us through any one of the forms enabled at the web or any one other means of contact indicated, will be treated with the purpose to attend your questions and requests. When necessary, we will send your request internally to the appropriate department for its correct management.
We will use your data to send you communications of interest if you have subscribed to our bulletins or have marked the corresponding box enabled at this effect.
We inform you that you can unsubscribe from this type of communications anytime in the way indicated at each communication received or by sending an e-mail to gdpr@barcelonabeta.org

Legitimation: The legal base for the treatment of your data is the consent, considered granted, when you provide us with your data and accept this data protection policy.

Deletion period: The data will be erased once your request has been meet. The data for the sending of information of interest will be kept indefinitely until you request its deletion.

 

2.2. INTERESTED AT PROJECTS OF ENQUIRY

The personal data that that you provide us to participate in a BarcelonaBeta research project will be processed for the following purposes:

  • The creation of a directory of candidates to participate in research projects.
  • To assess the suitability of the candidates based on their age, physiological characteristics and family medical history.
  • To manage the communications related with the projects that can be of your interest.

Legitimation: The legal base for the treatment of your data is the consent, granted by registering for candidate and the legitimate interest of BarcelonaBeta to send communications of interest.

Deletion period: Your personal and health data will be kept indefinitely until you request its deletion.

 

2.3. PARTICIPANTS AT PROJECTS OF ENQUIRY

The personal data of the participants in research projects will be processed for the following purposes:

  • To manage the research projects.
  • To manage the communications related with the project in which you participate.
  • The reuse of your data at other research projects related to the study in which you have participated.
  • To carry out a control of attendance to scheduled visits, at the waiting room of the building.

Legitimation: The legal base for the treatment of your data is the consent, granted when participating on a research project and the legitimate interest of BarcelonaBeta to send communications of interest. 

Deletion period: Your personal and health data will be kept indefinitely until you request its deletion.

 

2.4. PARTICIPANTS’ RELATED ONES

The personal data of the relatives of the participants in research projects processed for the following purposes:

  • To contact, when needed, for the evaluations of the participant’s studies. 
  • To manage the research projects.
  • Use of your data in research projects or analysis related to the study you and the participant are enrolled. 
  • To manage the communications related with the project in which you participate as “related one”.
  • To carry out a control of attendance to scheduled visits, at the waiting room of the building.

Legitimation: The legal grounds for the treatment of your data is the consent awarded and the legitimate interest of it BarcelonaBeta for the sending of communications of interest.

Deletion period: Your personal and health data will be kept indefinitely until you request its deletion.

 

2.5. CLINICAL TRIALS

The Clinical trials unit is a multidisciplinary team with the aim of developing clinical trials at the Pasqual Maragall Foundation-Barcelonabeta Brain research Center building.
The personal data of the participants in research projects will be treated with confidentiality and following the clinical and patient regulations for the following purposes:

  • To manage the clinical trials.
  • To manage the communications related with the clinical trial in which you participate.
  • Follow ups as participant of a clinical trial.
  • The reuse of your data at other research projects related to the study in which you have participated, only after the clinical trial sponsor authorization.
  • To carry out a control of attendance to scheduled visits, at the waiting room of the building.

Legitimation: The legal base for the treatment of your data is the consent, granted when participating on a clinical trial.

Deletion period: Your personal and health data will be kept indefinitely until you request its deletion.

 

2.6. COMMUNICATION

We will process your contact details in order to keep you informed about news, activities and projects of your interest. 

We inform you that you may unsubscribe as indicated in each submission received or by sending an e-mail to gdpr@barcelonabeta.org

Legitimation: the legal grounds for your data processing is the legal interest for the communication of our activities and projects. 

Deletion period: data will be stored as long as their deletion is not requested.

 

2.7. EMPLOYMENT: CV MANAGEMENT

The personal data that you provide us with when you send us your CV will be processed for the following purposes:

  • For staff selection during the processes that the company keeps open.
  • For researcher’s selection at the BarcelonaBeta Foundation. 
  • To maintain a file with CV information of the candidates (both researcher’s profiles and others) whose profiles meet the characteristics requested by the Foundation. 

Legitimation: the legal grounds for the processing of your data is your consent, which is considered given, with the voluntary submission of the CV.

Deletion period: Your CV will be stored for a maximum of 5 years and will be deleted subsequently, except due to different project or grant requirements.

 

2.8. CLIENTS

The personal data that you provide us with when you start the relationship as a client of the Foundation will be processed for the following purposes: client management, product sale, and sending communications of interest.

Legitimation: the legal grounds for the processing of your data is the presence of a contractual relationship.

Deletion period: data will be stored at all times for the period of the contractual relationship and subsequently for the legal periods established in the civil law for the termination of contractual obligations and the accounting and tax legislation.

 

2.9. VENDORS AND COLLABORATORS

The personal data that you provide us with when you start collaboration relationships and/or as a vendor of the Foundation will be processed for the following purposes:

  • Management of the services contracted: vendor registration, management of contracts, orders, and payments.
  • To maintain a contact database for future potential recruitment and/or collaborations.

Legitimation: the legal grounds for the processing of your data is the presence of a contractual relationship.

Deletion period: data will be stored at all times for the period of the contractual relationship and subsequently for the legal periods established in the civil law for the termination of contractual obligations and the accounting and tax legislation.
 

3.- Who will we communicate your personal data to?

The BarcelonaBeta Foundation will communicate your data in the following events:

  • By legal obligation: to the tax administration for the payment of taxes, to judges and courts that request it by judicial means.
  • Transfer required to conduct the services contracted: financial entities to execute the applicable collections and payments. We inform you that your data may be transferred to Pasqual Maragall Foundation, the collaborating entity of the BarcelonaBeta Foundation with whom it shares projects, services and provisions.
  • The “Curriculum Vitae” obtained from candidates for research positions may be communicated, according to their profile, to organizations, companies or institutions, at both a national and an international level, with which the BarcelonaBeta Foundation has agreements or preliminary agreements of collaboration or common projects, so that they can assess their suitability as candidates.

International data transfer: the BarcelonaBeta Foundation will not carry out any international transfer of your data.

 

4.- What are your rights in terms of data protection and how can you exercise them? 

Any person has the right to obtain information about which of his/her data are being processed in an organization. For this purpose, the Foundation indicates your rights below:

  • Right of access, rectification and erasure: the interested parties have the right to access their personal data, and to request the rectification of inaccurate data or, when applicable, to request their erasure when, among other reasons, data are no longer necessary for the purposes they were collected for.
  • Right to restriction of processing: under certain circumstances, you may request the restriction of your data processing, in which case data will only be stored for the exercise or defence of complaints.
  • Right to object to processing: under certain circumstances and for reasons related to your specific situation, you may object to the processing of your data. The Foundation will stop processing the data, unless for compelling legitimate reasons, or the exercise or defence of potential complaints.
  • Right to data portability: you will have the right to receive the personal data concerning you in a structured, commonly used and machine-readable format when: a) the processing is based on consent or on a contract, and b) the processing is performed by automated means.
  • Right to lodge a complaint with a supervisory authority: we inform you of your right to lodge a complaint with a supervisory authority (AEPD - www.aepd.es) in the event that the exercise of your rights hereby indicated has not been met.

In order to exercise the above-mentioned rights, you may contact us through postal or electronic mail to the addresses indicated in section 1, identifying the information below in your request:

  1. Applicant’s data (name and surname(s)).
  2. Contact address.
  3. Right to be exercised.
  4. Specific data based on which your request is made.

Within a maximum of one month, we will solve your request by notifying you through the same means that was used initially.

 

5.- What security does the BarcelonaBeta Foundation apply in the treatment of your data?

Taking into account the condition of the technique, the costs of application, and the nature, scope, context and purposes of the processing, in addition to risk of varying likelihood and severity for the rights and freedoms of the natural persons, the BarcelonaBeta Foundation will apply appropriate technical and organisational measures to ensure a level of security appropriate to the risk, which prevent the destruction, loss or accidental or illicit tampering of personal data transferred, preserved or processed otherwise, or the unauthorized disclosure or access to such data.

 

Privacy Policy - E-mail confidentiality

All e-mails sent from BarcelonaBeta Foundation domains may contain confidential or legally protected information and are exclusively addressed to the person or entity to which it is addressed. The content of these messages do not imply any commitment by the sender. If you are not the final recipient or person in charge of collecting it, you are not authorized to read it, retain it, modify it, distribute it, copy it or reveal its contents. If you have received an email by mistake, please inform the sender and remove the message and the attached material that may contain from your system.
